As we previously advised, Vibratex has been working on Trademark infringement exercises on the Amazon platform for several years and they have been proving themselves on the platform. We took additional steps to gain a stronger foothold within the platform that involved establishing Vibratex as Amazon seller.

The purpose for doing so was to afford us specific controls as the “brand” that we’d otherwise not have. Initially, this involved Vibratex stocking some product with FBA in order to get setup – however, our intent was and continues to be not to exist as a competitive entity on the platform.

As we mentioned, we engaged a third party to assist and manage these efforts. Their initial goals involved monitoring, platform cleanup, and focused on optimizing the listings for all authorized resellers, which you have assisted in providing.

Additionally, we’ll be tasking this firm to assist with the monitoring and take down efforts as it relates to listings not in compliance with the with the Retailer Agreement revised April 1, 2020, effective July 1, 2020.

At this time, we ask for your partnership and communication to your customers reminding them of the importance of their compliance to the MAP – Retailer Agreement, hereto enclosed, prior to February 1, 2021. Listings not in compliance to the agreement may be subject to take down and removal from the platform until revised.
