As the world’s leader in romance and lifestyle products, Kama Sutra is focused on maintaining high margins for our Reseller network. In recognition of the investment in time and resources required for our high-quality resellers to provide the level of customer service and product knowledge expected from our customers, Kama Sutra is committed to enforcing policies which allow our resellers to maintain high profit margins through the sale of our products. Kama Sutra has an established Minimum Advertised Price (MAP) Policy that an Authorized Reseller must follow for the advertising and marketing of Kama Sutra and RHYTHM products.
All Kama Sutra Authorized Resellers must agree to the terms and conditions of the following MAP Policy. In exchange for complying with MAP, Reseller is granted usage rights for all Kama Sutra and RHYTHM images, trademarks and logos.
RESELLER SHALL NOT PROMOTE, MARKET, ADVERTISE, OFFER TO SELL OR SELL ANY PRODUCT ON OR THROUGH ANY 3rd PARTY ONLINE MARKETPLACE OR AUCTION SERVICE. KAMA SUTRA WILL NOT HONOR PRODUCT WARANTY FOR ANY PRODUCTS BOUGHT AND/OR SOLD THROUGH SUCH MARKETPLACES (AMAZON, EBAY OR LIKE WEBSITES)
Kama Sutra MAP Policy Guidelines for Kama Sutra and RHYTHM Products The MAP for all Kama Sutra and RHYTHM products shall be no more than 20% less than the published list price found on the MAP Pricing sheet provided to you by Kama Sutra. All advertised prices must be at or above MAP for all Kama Sutra products. MAP pricing is established by Kama Sutra and may be adjusted by Kama Sutra at its sole discretion. Resellers are also responsible for ensuring their Kama Sutra Mount pricing is at or above MAP on internet search engines.
Resellers are free to set the actual resale price of any product as long as it is at or above MAP price given the most recent publication of the price list. Kama Sutra’s MAP policy for all Kama Sutra products apply to advertising placements, including but not limited to: print ads (inserts, magazines, newspapers, catalogs, mail order catalogs, etc.), broadcast (radio and TV), direct mail, faxes, internet placement with third parties (banner ads, broadcast emails, destination pages, third-party sites), internet placements on resellers own website, and any flyers, posters or coupons.
INITIALS: _______ KAMA SUTRA® MAP AGREEMENT 2017 PAGE 2 Failure to Comply with the MAP Policy At the sole discretion of Kama Sutra failure to comply with MAP, intentional and/or repeated failure to abide, may result in the immediate loss of Authorized Reseller status and your ability to purchase all Kama Sutra and/or RHYTHM products both direct as well as through distribution.
Usage rights to Kama Sutra trademarks, logos and imagery will be immediately revoked. Kama Sutra will utilize the following steps to resolve MAP violations: Any and all dealers selling Kama Sutra products which have not signed a Kama Sutra MAP Policy agreement are classified as Unauthorized Resellers.
Products bought and/or sold through Unauthorized Resellers will be deemed as counterfeit and Product Warranty will not be honored. Distributors of Kama Sutra are required to provide a signed MAP agreement from any dealer selling Kama Sutra products. Unauthorized dealers should not be sold to or provided a feed from any distributor whatsoever. Kama Sutra will not provide prior written notice or issue warnings before taking action under this policy. MAP Policy Confirmation Agreement This Kama Sutra MAP Policy and Confirmation Agreement is made on this date of _____________, by and between, Kama Sutra and
____________________________________. Kama Sutra places great value on the efforts of all resellers to represent our products and support their customers. Our MAP policy is intended to encourage competition for the sale of Kama Sutra products in a manner that is consistent with the long-term interests of our customers. We are sure that you share our commitment to customer satisfaction and as such, we ask that you acknowledge by signing this MAP confirmation agreement.
